This e-shop is operated by KiRiVOO, a company registered in Estonia. Customers do not need to register as a user to buy from www.kirivoo.com e-store. Always read the Terms & Conditions before making an order. After submitting an order, Customer agrees to the Terms & Conditions:
1.1. These Terms & Conditions govern the legal relationship between KiRiVOO OÜ (KiRiVOO), registry code 12889846, and the person (Customer) who purchases from the www.kirivoo.com e-shop.
1.2. Throughout the site, the terms “we”, “us” and “our” refer to KiRiVOO. KiRiVOO offers this website, including all information, products and services available from this site to you, the Customer, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
1.3. KiRiVOO may update, change or replace any part of the Terms & Condition of sale and the prices of products/services on sale in the KiRiVOO e-store. Any changes must be posted in the e-store environment. All transactions are subject to terms and prices in effect at the time of the transaction. Customer should review the most current version of the Terms of Service at any time on this page - this is Customer responsibility to check this page periodically for changes.
1.4. KiRiVOO has the right to withdraw from the sales agreement and not to deliver the ordered products or provide the promised services in the following cases:
- KiRiVOO reserves the right to refuse service to anyone for any reason at any time;
- the product has run out of stock and cannot be made to an order;
- the product price or information has been displayed incorrectly due to a system error.
1.4.1. When KiRiVOO withdraw´s the sales agreement, Customer will be contacted by e-mail or telephone, and money will be refunded if Customer has arrived to make the transaction.
1.5. KiRiVOO store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to a Customer.
1.6. In addition to these Terms and Conditions, the legal relationships induced by marketing products via the KiRiVOO e-store are governed by the laws of the Republic of Estonia.
TIMELINESS OF INFORMATION
2.1. Certain content and services available on KiRiVOO site may include materials from third-parties. KiRiVOO site may also contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. KiRiVOO reserves the right to modify the contents of this site at any time, but we have no obligation to update any information on the site. The material on this site is provided for general information only.
2.2. Product information is regularly checked and improved. The data may have changed since the last visit.
2.3. Third-party links on this site may direct you to third-party websites that are not affiliated with KiRiVOO.
PRICE/PRODUCT POLICY
3.1. KiRiVOO prices, availability and descriptions of products can change anytime without notice.
3.2. All prices are listed in euros (EUR). Prices are valid provided that payment is made on time. For purchases made from the United Kingdom, the final amount payable in GBP will be determined by Customer's payment provider according to their applicable exchange rates and fees.
3.3. The prices of products are available on the product page and include the VAT applicable in the Republic of Estonia, which is 24%.
3.4. The shipping fee is calculated in the checkout if free delivery Terms & Conditions are not met by the Customer.
3.5. KiRiVOO reserves the right to limit the quantities of any products or services that we offer. KiRiVOO reserves the right to discontinue any product at any time.
MAKING AN ORDER
4.1 Ordering can be done online by adding product(s) in the shopping basket. Customer can also insert and change the quantity of product(s), and should click on "buy" to submit an order.
4.2 After choosing the delivery option - payment options are shown. Choose the payment option. After choosing a payment option, fill in personal information.
4.3 Please be careful when filling in personal information as it will play a vital role in delivering the shipment on time.
4.4 The sales agreement is considered final when the payment has been made to the account of Kirivoo OÜ.
4.5. KiRiVOO reserves the right to refuse any order you place with us. In the event that KiRiVOO makes a change to or cancels an order, the Customer would be notified and contacted through the email and/or phone number provided at the time the order was made.
4.6. After ordering, Customer will receive an order confirmation and delivery information.
PAYING FOR THE GOODS
5.1. In order to make the payment, Customer needs to choose the suitable payment method.
5.2. Payments can be made as follows:
5.2.1. Credit card (Visa, Mastercard, Amex, Apple Pay)
Third-party service provider for secure payments - Shopify Payments. Money arrival to the KiRiVOO's account can take 48-65 hours.
5.2.2. Credit card (Paypal)
Third-party service provider for secure payments - Paypal. Instant payment.
5.2.3. Bank link (Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Poco pay, Nordea, Danske Bank and others)
Third-party service provider for secure payments: Montonio Finance OÜ or Maksekeskus AS. KiRiVOO doesn't get to see and save any credit card data but processes and forwards Customer's personal information to the third-party service provider. Click on the button 'Back to merchant' after the payment is completed.
5.2.4 Pay later (Liisi ID, Indivy) if the purchase sum is minimum 75 euros
Third-party service provider for secure payments - Maksekeskus AS. KiRiVOO doesn't get to see and save any credit card data but processes Customer's personal information and forwards it to the Maksekeskus AS. Click on the button 'Back to merchant' after the payment is completed.
5.2.5 Kniks gift card (Estonia, Latvia, Lithuania)
Third-party service provider for secure payments - Maksekeskus AS. KiRiVOO doesn't get to see and save any credit card data but processes Customer's personal information and forwards it to the Maksekeskus AS. Click on the button 'Back to merchant' after the payment is completed.
5.2.6. Bank transfer (invoice)
Company name: Kirivoo OÜ. Bank Name: Swedbank. Bank Account: EE342200221062488779. SWIFT code/BIC: HABAEE2X.
5.3. The order will be cancelled if the payment has not arrived within 72 hours.
5.4. Customer should pay 100% in advance for purchases made in the KiRiVOO e-store.
5.5. KiRiVOO is not responsible for any issues or losses related to purchases or use of goods, services, content, or other transactions through third-party websites (see 5.2.1.). While we only work with reputable and respected companies, we encourage our Customers to review the third party’s policies and practices carefully before making any transaction. If Customers have any questions, concerns, or complaints about third-party products, we advise to contact the third party directly, or reach out to us and we will do our best to assist.
DELIVERY INFORMATION
6.1. KiRiVOO e-store is shipping products from Estonia to all European countries. Main delivery partners are Omniva, DPD, DHL and FedEx. KiRiVOO offers a FREE drop box service in Estonia, Latvia and Lithuania. As well as, FREE standard delivery to all EU countries and the UK.
6.2. After the finalisation of the agreement as determined in paragraph 4.4. the goods will be delivered to the place determined by Customer. Generally our products are made to order. Orders are usually delivered within 10 to 14 days in Estonia and 14 to 28 days throughout Europe. Find all details from KiRiVOO's Shipping Policy.
6.3. After placing an order, the Customer will receive an order confirmation e-mail. The tracking number of the shipment will be sent to the Customer by e-mail or phone once the product has been dispatched.
6.4. The courier company will deliver the parcel to the address stated in the order. Please note that is not possible to change it after the order has been made.
6.5. KiRiVOO strongly recommends that the Customer checks the package immediately upon receipt and notify us by e-mail in case of any damage.
6.6. Please be aware that the correct details and delivery address effect delivery process. Please double check if the contact information is correct to avoid misunderstandings and delay of delivery. KiRiVOO and the delivery company are not responsible for delay in delivery and misunderstandings that are caused by incorrect contact information presented by Customer.
RIGHT OF EXCHANGES
7.1. KiRiVOO accepts exchanges depending on the type of issue and product availability within 45 days of purchase, provided that the product is returned in its original state, including original packaging, unused condition, and all labels and accompanying documents:
7.1.1. For garments, KiRiVOO offers alterations if the Customer experiences any issues with the fit. Alternatively, the Customer may exchange the item for another size or a garment of similar value, provided it is available in stock.
7.1.2. Many of KiRiVOO's products are available exclusively online through the website and are made to order. Exchanges are limited to products that are in stock, and personalised (also engraved), custom-made and damaged products can not be exchanged. This does not affect the Customer's statutory rights in case the product is faulty or incorrect.
7.2. Before returning a product, the Customer must notify us by submitting this form or in-case of any unexpected technical issue, by notifying us via e-mail. The e-mail should contain the following information: the Customer’s full name, order number, SKU or style name and size of the product (if applicable), the reason for exchange, and images of any product non-conformity or defects. KiRiVOO will then provide the Customer with further information and instructions.
RIGHT OF RETURNS, WITHDRAWAL & REFUNDS
8.1 KiRiVOO accepts returns within 45 days of purchase, provided that the product is returned in its original state, including original packaging, unused condition, and all labels and accompanying documents. Proof of purchase and shipping is required.
8.1.1. Before returning a product, the Customer must notify us by submitting this form or in-case of any unexpected technical issue, by notifying us via e-mail. The e-mail should contain the following information: the Customer’s full name, order number, SKU or style name and size of the product (if applicable), the reason for returning, and images of any product non-conformity or defects. KiRiVOO will then provide the Customer with further information and instructions.
8.1.2. The returned product has to include all parts that were initially in the box. In case the purchase included extra products handed out during a campaign for free, Customer needs to return these as well. If any items are returned that were part of a multi buy promotion, all items must be returned.
8.1.3. KiRiVOO is not obligated to accept a damaged product. As well as, if the original packaging is damaged, the Customer must compensate for the decrease in value (this does not apply to postal packaging).
8.1.4. Personalised (also engraved) products and custom made products are non-returnable/non-refundable. However, this does not affect the Customer’s rights in cases where the product is faulty or incorrect.
8.1.5. Products should be returned by post following KiRiVOO’s instructions, which will be emailed to you. We operate from several facilities, including an address in London. Unless otherwise informed or agreed, goods must be returned to the following location: KiRiVOO, Sikupilli Prisma DPD Drop Box, Tartu mnt 87, 10112 Tallinn, Estonia.
8.1.6. In the case of an item with an evident defect that does not require further inspection, KiRiVOO will provide a pre-paid shipping label for its return. For all other returns, the Customer is responsible for delivery costs up to €10. Should the delivery cost exceed this amount, KiRiVOO will cover the difference. Returns must be made using a delivery service approved by KiRiVOO. If a Customer has clearly chosen a manner of delivery of an item different from the cheapest regular manner of delivery of an item provided by KiRiVOO, KiRiVOO shall not refund the cost exceeding the cost of the regular manner of delivery (§ 561 (3) of VÕS).
8.1.7. If a Customer withdraws from a contract, KiRiVOO will refund the purchase provided that the product cannot be repaired or replaced and satisfies the conditions for a refund. If a Customer returns all products, a full refund of the order will be issued (including the delivery charge). If a Customer returns a selected item, the refund will cover the item's price and the delivery charge. KiRiVOO will process the refund as soon as possible but may delay it until the returned product has been received. Refunds will be made using the same payment method as the original transaction. If the refund has not been received within 14 days from the date of return shipment, the Customer should contact KiRiVOO via e-mail, as the returned item may not yet have been received.
8.2. KiRiVOO's personalised and custom-made products can only be returned to repair in accordance with our Warranty Policy:
8.2.1. KiRiVOO offers a lifelong repairs and warranty against product's manufacturing defects, valid for as long as the original Customer owns the product. In such cases, we will repair or replace the product free of charge.
8.2.2. The lifelong warranty does not cover damage resulting from normal wear and tear, accidents, misuse, fading, exposure to harsh chemicals, or any alterations, servicing, or repairs performed by anyone other than KiRiVOO.
8.2.3. We also offer 1-year warranty against accidents. And, after 1 year, we can still help keep your product looking its best by offering repairs, professional silver cleaning, or gold replating for a small fee.
8.2.4. If a Customer’s case falls under the terms of our warranty, the Customer must complete and submit the Warranty & Returns Request Form and is expected to return the item for evaluation to the address provided by KiRiVOO. The cost of returning the item shall be paid by the Customer.
8.2.5. If the Customer’s product cannot be repaired or reproduced under the warranty, KiRiVOO will provide a replacement product of similar style or equivalent value. This warranty is provided in addition to, and does not affect, the Customer’s statutory rights under applicable law.
8.3. The Customer may return the product to us under our Take-Back Scheme.
CLAIMS
9.1. KiRiVOO will be liable for product non-conformity and defects.
9.2. KiRiVOO will not take responsibility in the following cases:
- Customer has damaged the product;
- Shortcomings that have appeared due to wrong usage of the product;
- The product has experienced normal wear and tear.
9.3. If a Customer notices product non-conformity or defects, they must immediately notify KiRiVOO (see 8.1.1.) and wait for the further instructions. The correct/right item will be posted as soon as possible after the faulty/wrong product has been returned to KiRiVOO.
9.4. If a Customer and KiRiVOO do not come to an agreement, there is need for expert evidence. Please note that in that case, the expert evidence costs will be paid by the party, who turns out to be guilty.
9.5. The Customer has the right to claim money back if the product cannot be repaired or replaced or if the defect occurs twice.
9.6. KiRiVOO has the right to not repair or replace the faulty/wrong product. In such case we will offer a full refund.
PERSONAL INFORMATION
10.1. All personal information connected to purchases are considered confidential. KiRiVOO has no access to bank information.
10.2. Encrypted communication channels with banks guarantee the safety of personal and banking data. Credit card information is always encrypted during transfer over networks.
10.3. Customer´s submission of personal information through the KiRiVOO e-store is governed by our Privacy Policy.
OTHER TERMS
11.1. If a Customer sends creative ideas, suggestions, proposals, plans, or other materials, whether online, by e-mail or otherwise (collectively, 'comments'), the Customer agrees that KiRiVOO may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (a) to maintain any comments in confidence; (b) to pay compensation for any comments; or (c) to respond to any comments.
11.2. KiRiVOO products through this e-store are intended for personal use only. Any purchase made for the purpose of resale, distribution, or other commercial exploitation without the prior written consent of KiRiVOO is strictly prohibited. KiRiVOO reserves the right to cancel any orders that appear to be placed for resale purposes and to take legal action in cases of fraudulent or unauthorised resale.
11.3. Questions and cases not determinated in these Terms & Conditions will be settled according to the legislation valid in the Republic of Estonia.
11.4. Any disagreements between Customer and KiRiVOO will be solved by negotiations. If an agreement is not reached, the Customer may seek protection of their rights from the Consumer Claims Commission via the Consumer Protection Board. Any disputes will be settled according to the law of the Republic of Estonia.
TERMINATION
12.1. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
12.2. The Terms of Service are effective unless and until terminated by either Customer or KiRiVOO.
DISCLAIMER
13.1. Product pictures have illustrative meaning. KiRiVOO has made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.
13.2. Information, product prices and availability can change without advance notice.
13.3. Product information is regularly checked and improved. The data may have changed since the Customer´s last visit.
13.4. KiRiVOO can not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. Customer agrees that from time to time KiRiVOO may remove the service for indefinite periods of time or cancel the service at any time, without notice.
13.5. KiRiVOO and Customer take mutual responsibility for damage caused to the other party by violating these Terms & Conditions as determined by the legislation of the Republic of Estonia.
13.6. KiRiVOO does not take responsibility for damage caused to the Customer or delay of the delivery if it is caused by circumstances KiRiVOO has no power to change and cannot foresee i.e. force majeure.
